Nineteen Democratic state attorneys general have initiated a lawsuit against the Trump administration following a federal judge’s preliminary injunction stopping Elon Musk’s Department of Government Efficiency from accessing sensitive Treasury records. The lawsuit alleges violations of federal law tied to the handling of personal data in the Treasury’s payment system, raising significant security and administrative concerns. In a major legal blow for the Trump administration, a federal judge has issued a preliminary injunction that blocks Elon Musk’s newly formed Department of Government Efficiency (DOGE) from gaining access to highly sensitive records held by the Treasury Department. This ruling came as a result of a lawsuit filed by a collective of 19 Democratic state attorneys general.
The lawsuit claims that President Trump’s administration broke federal law by allowing Musk’s team to access the Treasury Department’s central payment system—a system that is responsible for managing tax refunds, Social Security benefits, and veterans’ benefits while handling trillions of dollars annually. It’s a serious matter, especially since the system contains sensitive personal data.
The U.S. District Judge Paul A. Engelmayer made it clear that any unauthorized access to these records since January 20 must lead to the immediate destruction of any copied material from the Treasury’s systems. Elon Musk’s DOGE was established with the noble aim of identifying and eliminating wasteful government spending. However, opinions are sharply divided. Critics voice their concerns about Musk’s growing influence through this agency, while supporters cheer on the initiative, claiming that it fosters fiscal responsibility.

New York Attorney General Letitia James highlighted potential security issues, especially regarding the risk of illegal fund freezes that could arise from DOGE’s access to sensitive data. Connecticut Attorney General William Tong didn’t hold back, calling the situation “the largest data breach in American history.” The allegations suggest that Musk’s inquiries within Treasury systems even included attempts to identify ways to suspend payments from the U.S. Agency for International Development.
The political tensions surrounding DOGE have prompted various Democratic lawmakers to call for a thorough investigation into how this agency is interfacing with government payment systems. Furthermore, labor unions and advocacy groups have joined in, filing lawsuits against the legality of DOGE’s review of Treasury operations.
In response to rising legal challenges, a judge in Washington has already restricted access for only two DOGE staff members, limiting them to “read-only” privileges concerning the Treasury’s systems. This is just one of many lawsuits that the Trump administration is currently facing, which includes ongoing challenges related to federal funding, immigration policies, and rights for transgender individuals.
As legal opposition continues to mount, Democrats are increasingly utilizing lawsuits as a strategy to counteract Trump’s policies—making this one compelling issue to watch in the coming months.
